Despite generally falling rates in the last few years, it still remains the case that there are around 12 divorces for every hundred marriages each year in the UK, meaning a total of over 120,000 couples going their separate ways, with the highest rate among those in their late twenties. It is also usually the case that children are involved in the divorce, with just over half of divorces involving a child under the age of 6. In addition, although they have only been in existence since 2005, there are over forty dissolutions of civil partnerships recorded each year.

One important misconception about divorce and disputes over children is that court proceedings are a necessity. In fact, the majority are settled by paper negotiations only. For divorce, one of the five bases will need to be established, which include adultery, unreasonable behaviour, desertion for two years, living apart for two years with agreement by both parties, or living apart for five years where only one party wishes to divorce. A lawyer will be able to help you to establish these, and whether or not there are sufficient grounds to proceed any further. There are then several stages of serving the court with the divorce petition and official acknowledgement, after which divorce is pronounced as 'Decree Nisi', and finally 'Decree Absolute' which is the final official divorce.
