Patent

Patents exist to grant protection on inventions to the person creating them. Protection lasts for twenty years from the date that the patent is issued, and provides protection throughout the UK. As each country has its own parent laws, protection of an invention outside the UK can be difficult, and will require separate applications in different countries. If this may be an issue to you, you should seek a Patent Attorney or solicitor with experience of this.

One of the requirements of being awarded a patent is that the information is not made public. What this means is that you need to be very careful in your dealings with other people and businesses before your patent application is lodged. If you do discuss your invention with anyone, a solicitor will be able to draft a confidentiality agreement to prevent them from stealing or sharing your idea. A patent application requires a specification to be filled out, which details the nature of your invention and what it will cover, meaning that you should use a registered Patent Attorney to help you file your application. An experienced patent attorney will also be able to review your invention and give you some idea as to the likelihood of success before the full search is completed with the UK Intellectual Property Office. The entire process can be lengthy and expensive, and Patent Attorneys may be able to advise you on commercial aspects - such as whether is possible for a holding company to own the patent and for part of this company to be sold to an investor.
